Why not charge the magic Hermione with a minor in the Chamber of Secrets?

In Chamber of Secrets Harry Hermione repair vessels for the second time in Diagon Alley. Why does not the Ministry of Magic prosecute her for underage magic?

That's because you do not know it was Hermione who used the spell. It could have been anyone in Diagon Alley. Dumbledore has said that the Ministry can not say exactly who uses magic in a given area but has been used, and that the Ministry is based on the wizard and witch parents to enforce the prohibition of underage magic in their homes. And You Can not use presence of Muggles or Muggle-inhabited area, which is how Harry was caught. But as Diagon Alley is free to muggles, okay.
